Terms of Service

Please review the following terms and conditions that govern your use of our services and website.

These Terms of Service ("Terms") govern your use of the jcandjchvacmechanical.com website and the heating, ventilation, and air conditioning services provided by JC & JC Mechanical Contractors LLC ("JC & JC Mechanical," "we," "us," or "our"), located at 1614 Maydale Dr, Silver Spring, MD 20905. By accessing our website, submitting a form, calling us, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Our Services

JC & JC Mechanical provides residential and commercial HVAC services, including air conditioning, heating, heat pump, furnace, boiler, ductwork, ductless mini-split, water heater, gas line, and air quality services in Silver Spring, MD and the surrounding Montgomery County and DMV area. All services are subject to technician availability and may vary by location and season. We reserve the right to decline work that is unsafe, outside our licensing scope, or otherwise at our reasonable discretion. Emergency service is offered 24/7 and may be subject to after-hours rates, which we disclose before work begins.

Estimates and Pricing

  • Estimates for replacement and installation work are free unless otherwise stated and are provided before work begins.
  • Estimates are based on conditions visible and information available at the time of assessment. If additional work, code corrections, or hidden conditions (for example, damaged ductwork behind finished walls) are discovered, we will explain the change and get your approval before proceeding.
  • Diagnostic or service call fees, when applicable, are quoted when you book and are due even if you decline the repair.
  • Advertised promotions and rebates are subject to their stated terms, expiration dates, and eligibility requirements of the sponsoring utility or manufacturer.

Scheduling and Cancellation

Appointments are scheduled in arrival windows based on availability. We make every effort to arrive within the scheduled window and will communicate delays.

  • Please provide at least 24 hours notice to cancel or reschedule when possible.
  • Missed appointments without notice may be subject to a service call fee.
  • Please ensure safe access to equipment (attics, crawl spaces, mechanical rooms) and secure pets during the visit.

Payment Terms

  • Payment is due upon completion of work unless we have agreed in writing to other terms (for example, financed installations or progress payments on larger projects).
  • We accept major credit cards, checks, and approved financing.
  • Financing is provided by third-party lenders, is subject to credit approval, and is governed by the lender's separate agreement with you.
  • Returned checks and past-due balances may be subject to fees and interest to the extent permitted by Maryland law, and we may suspend warranty service on unpaid work until the balance is resolved.

Permits and Code Compliance

Where required, mechanical, electrical, or gas permits will be obtained for your project from the appropriate authority (for example, Montgomery County Department of Permitting Services or your municipality), and work will be performed to applicable code. Permit and inspection fees, when applicable, are itemized in your estimate. You agree to allow reasonable access for any required inspections.

Warranties and Guarantees

We stand behind our work:

  • Labor warranties on repairs and installations are stated on your invoice or proposal and vary by service type.
  • Manufacturer warranties apply to installed equipment and parts and are provided by the manufacturer under its own terms. We will register equipment warranties on your behalf where applicable.
  • Warranties do not cover damage caused by misuse, neglect, lack of required maintenance, power surges, acts of nature, or modification or repair by anyone other than our technicians.
  • Warranty claims require reasonable access to the equipment and a paid-in-full account for the work being claimed.

Customer Responsibilities

  • Provide accurate information about your property, equipment, and any known issues.
  • Maintain equipment per manufacturer recommendations, including filter changes between maintenance visits.
  • Inform us of any hazardous conditions (asbestos, mold, pests, structural issues) known to you before work begins.

Communications and SMS Consent

By providing your phone number and checking the consent box on our forms, you agree to receive calls and SMS/text messages from us about your inquiry, appointments, and services as described in our Privacy Policy. Limitation of Liability

To the maximum extent permitted by law, JC & JC Mechanical shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our services or website, including loss of use, loss of income, or damage not caused by our negligence. Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under Maryland law, including liability for gross negligence or willful misconduct.

The content on our website is provided for general informational purposes only and does not constitute professional advice for your specific system or property.

  • You agree not to misuse the website, attempt to gain unauthorized access, or submit false, unlawful, or abusive content through our forms.

Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Montgomery County, Maryland, and you consent to the jurisdiction of those courts. Nothing in this section limits any rights you may have under the Maryland Consumer Protection Act or the jurisdiction of the Maryland Home Improvement Commission over licensed contractor work.

Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and any signed proposal or invoice for your specific project, are the entire agreement between you and JC & JC Mechanical regarding our website and services. Signed project documents control over these general Terms if they conflict.

Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
